RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

In consideration of being accepted as a participant (“Participant”) of WP Fitness LLC, Charles Henrique dos Anjos, Thadeu Alves Vieira, Matthew Miller, Gabriel Rizzini and Bruno Costa (DBA as Wolfpack BJJ Academy) at 3627 Webber ST unit B, Sarasota, FL 34242 and being permitted to participate in programs and activities such as martial arts events, seminars, training activities, and programs such as Brazilian Jiu-Jitsu, Muay Thai, Judo, Boxing, Wrestling, Submission Wrestling, Luta Livre, MMA, Mixed Martial Arts, Yoga, cardio and stretching, by submitting my information below electronically and payment for membership and classes, I hereby understand and agree to the following:

1. Physical condition

a) I hereby certify that I am in good physical condition, and have no disease, injury or other condition that would impair my performance or physical and mental well-being during intense training, practice and/or competition. I hereby acknowledge that I have been advised by Wolfpack BJJ Academy and its owners, partners, contractors, instructors, assistant instructors, volunteers and students to undergo a physical examination by a physician to confirm that I am in good physical condition.

2. Martial arts and its risks

b) I Acknowledge and fully understand that I will be engaging in martial arts as a contact sport. I understand that martial arts can involve throwing, wrestling, chokes, arm locks, strikes, punches, kicks, uncomfortable positions and being in close contact with others. Learning new techniques and training with others involves a risk as the person, the movement and the use of force may be unfamiliar and unanticipated.

Though Wolfpack BJJ Academy takes steps to provide a safe training environment for everyone, risk of injury is an unavoidable and necessary aspect of learning martial arts in a realistic manner. Consequently, I understand that my being a Participant might result in an injury, including a serious injury and possibly including permanent disability or death, and severe social and economic losses due to not only my own actions, inactions, or negligence, but also to the actions, inactions, or negligence of others, or conditions of the premises or of any equipment used.

I understand that I have the responsibility to ask questions about any perceived risk of any activity and that I have the responsibility and right to not participate in any activity I deem potentially hazardous to myself or to others and/or for any activity for which I do not wish to assume the risk.

I hereby grant permission in case of injury to have a doctor, nurse, athletic trainer or other emergency medical personnel provide me with medical assistance or treatment for such injury. I understand that medical treatment provided to me as a result of injury may be limited to basic first aid.

3. Rules of Wolfpack BJJ Academy; Membership as a privilege

c) I agree to act responsibly and respectfully at all times, including outside of class and organized activities, and to follow the rules of Wolfpack BJJ Academy set forth below, and to participate in all activities in a manner that reduces the risk of injury to myself and to others. I understand that my membership in Wolfpack BJJ Academy is a privilege that can be revoked at the sole discretion of Wolfpack BJJ Academy, with a refund provided for the unused portion of the membership minus any damages or reasonable assessments.

1. d)  I understand and agree that as a Participant of Wolfpack BJJ Academy I will be learning special techniques and have access to special information that provides Wolfpack BJJ Academy with a business advantage over other martial arts schools in the area. Consequently, I agree not to take classes or to participate or attend other martial art school or to open my own martial arts school within a 25-mile radius of the Wolfpack BJJ Academy training facility located at 3627 Webber ST unit B, Sarasota, FL 34242, without the express written consent of the owner, Charles Henrique dos Anjos.
2. e)  Wolfpack BJJ Academy does not assume any responsibility for the loss, damage or theft of any property of any Participant. Participants are responsible for their own property while participating in any and all activities associated with Wolfpack BJJ Academy.

4. Authorization to Take and Use Photographs/Video

f) I further understand that videos, pictures, audio and other types of media might be taken during classes by the owner, partners, contractors, instructors and assistants, and tournaments and that it may also be shown to audiences around the world, shared and/or published on the internet. I hereby expressly and irrevocably forever consent to having my likeness shown, publicized, commented and/or reported on; and I do not expect to, and in fact waive any compensation I might otherwise be entitled to as a results thereof.

5. Waiver, Release of Liability, covenant not to sue; indemnification

I hereby Release, waive, discharge and covenant not to sue Wolfpack BJJ Academy, its affiliated organizations and governing bodies, their officers, instructors, volunteers, students and personnel, other members of the organizations, participants, supervisors, coaches, sponsoring organizations or their agents, and if applicable, owners and leasers of the premises from any and all liability to the undersigned, his or her heirs and next of kin for any and all claims, demands, losses and damages which may be sustained and suffered on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasees or otherwise, to the fullest extent permitted by law.

I HAVE READ THE ABOVE WARNING, WAIVER, RELEASE, AND ASSUMPTION OF RISK. I FULLY UNDERSTAND ITS CONTENTS, AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT ELECTRONICALLY. I HEARBY AGREE WITH THIS AGREEMENT VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY ELECTRONIC SIGNATURE VIA THIS FORM SUBMISSION BELOW TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW.
